That is the same NextDay AI that runs SpicyChat, which is why the two platforms share a Discord and a family resemblance in their legal pages. The terms are governed by Quebec law with exclusive jurisdiction there, and they carry a class-action waiver that pushes disputes to individual arbitration. The privacy policy names Google Analytics and the usual categories of service providers and professional advisers, but it does not say where the data is hosted and does not describe cross-border transfer safeguards, which the Nastia AI policy does in two sentences. For a company with a Cyprus entity that presumably exists to serve European users, that is an odd gap.

What GirlfriendGPT collects and how long it keeps it

Six years is the retention period stated for personal information after you cease being a user, and the policy does not separate chat logs from account records when it says so. Read plainly, that means the conversations you had on GirlfriendGPT can sit on NextDay AI’s systems until the early 2030s after you delete your account. The policy grants GDPR erasure rights and says the company will delete or remove personal data on request, immediately qualified by “we may not always be able to comply with your request of erasure for specific legal reasons”. There is no export tool mentioned. The content-removal policy is better: complaints about content that resembles a real person are reviewed within five business days, illegal content comes down immediately, and a declined request can be escalated under the complaint policy to an independent reviewer at GirlfriendGPT’s expense, which is a real process and more than most platforms offer.

Training, licences and the age gate

The policy does not say whether your chats are used to train models, and neither do the terms. What the terms do say is that GirlfriendGPT receives a “global, non-restricted, royalty-free, perpetual, irrevocable” licence to your content, and that “Modified Content will be the singular and exclusive property of GIRLFRIENDGPT”. That is a wider grant than the “operate and improve” wording on most competitors, and it is the second reason for the grade. That last sentence is an admission: consistency is the problem. Two independent reviews describe the face drifting between poses and outfits, the one detailed Trustpilot review says the generator “repeatedly creates exactly the same thing”, and my own renders of the same character varied more than Secrets AI or Candy AI would allow. The output is attractive, the anime side is strong, the realism is a tier below the image-first apps.

Premium gets neither, and independent testers describe its standard context becoming incoherent after fifteen to twenty messages. That matches the pattern I saw and it is why the Premium plan does not appear in my recommendation at all.

Open a chat and the panel labelled Manage Memories shows two lists: the memories the AI created automatically to “remember key details”, and your own saved memories, which you can add, edit, delete, select in bulk and clear.
